The phenomenon of equity applied by a judge can find a “new” position within the supra-national legal system diachronically and free of the former conflict by a competing, parallel form of justice which is present in Anglo-Saxon case law. Nevertheless, equity may not contribute to mediating and settling disputes which often arise in the subject of human rights in the EU law according to the Charter of Fundamental Rights according to Protocol n. 30.
